Design Services — Terms & Conditions
These Terms & Conditions govern the interior design, interior styling, and virtual design services provided by Sundays In Bed Sdn Bhd (Company No. 202301010516) (“Sundays in Bed,” “we,” “us,” “our”) to residential clients (“you”) in Malaysia. They apply once you accept a Scope of Works proposal from us, and together with that proposal — which sets out your specific project’s rooms, fees, and timeline — form the whole agreement for your project. Please read this before signing your Scope of Works.
1. Scope of services
Our interior design service runs across six stages, set out in full in your Scope of Works:
- Discovery & feasibility — understanding your brief and a preliminary look at the site, confirming the project is feasible, before any fee is charged.
- Design concept — spatial layout options, a design concept and moodboard for your approval.
- Design development — refined moodboards, finalised floor plans, key views/elevations, initial FF&E selections, and an initial built-in carpentry concept.
- Drawings & specifications — finalised elevations, M&E (mechanical & electrical) drawings, a finishes and ironmongery schedule, a furniture shopping list, and the built-in carpentry deck issued to the contractor.
- Mobilisation — reviewing the design with our appointed contractor, on-site liaison, and concierge procurement support through to handover.
- Feedback — once you’re all settled in, we’d love to hear how you’re feeling about your new home. And if you’re happy with the experience, we’d really appreciate a little review too. Only stages 1–5 carry deliverables and fees; stage 6 is relationship, not a chargeable phase.
“Interior design service” covers concept and mood boards, space planning, furniture/fixture/material selection and sourcing, finishes and carpentry specification, and coordinating/project-managing your appointed contractor during the build. Exact rooms, deliverables, and fees for your project live in your individually issued Scope of Works — that document, not this page, defines what you’re paying for.
Excluded, always: we are interior designers, not a construction, electrical, or plumbing contractor, and we don’t hold a contractor’s licence.
- The cost of carpentry, built-in works, and construction materials themselves
- Labour and materials for any contractor, electrical, plumbing, or structural work
- Building permits, strata/JMB or MC approvals, or any other regulatory sign-off — you’ll need a licensed contractor, engineer, or the relevant authority for these directly; we’ll advise, but the responsibility and the licence sit with them
We collate and compile quotations from various suppliers and contractors, and propose how these can best meet your budget — for your approval before any construction work is committed. We treat the build phase with the same commitment to quality as the design phase, working closely with the contractor to help bring the project to life as intended.
Scope is fixed to what’s in your Scope of Works. Anything requested after a stage is signed off is additional scope — see Section 2.
2. Fees, payment & cancellation
All fees are in Malaysian Ringgit (RM). Your total design fee (per your Scope of Works) is billed in six stages:

An invoice is issued on completion of each stage. The Stage 2a deposit (10%) is your project deposit and is required before any Stage 2 work begins.
Late payment: the final balance is due within 10 working days of project completion. Amounts unpaid after that are subject to statutory interest of 5% per annum.
Out-of-scope work: anything outside your approved Scope of Works — including changes requested after a stage is signed off, or extra work made necessary by delays outside our control (see Section 3) — is billed at our daily rate of RM300/day.
Cancellation: you can cancel at any time. This doesn’t generate a refund of fees already paid; instead you’re billed for work actually completed up to the point of cancellation, pro-rata as a percentage of the relevant stage. No penalty beyond paying for work already done.
3. Timelines & delays
Stage timelines in your Scope of Works are estimates based on typical pace and your meeting availability — not guarantees. Timelines can move for reasons outside our control: supplier/manufacturer lead times, contractor availability and pace, customs/import/delivery delays on furniture and materials, and delays in your own decisions, approvals, or sign-offs.
Because later stages build on earlier approvals, a slow decision early on pushes everything after it. Please treat requested approvals as time-sensitive. Where an outside-our-control delay causes extra design work, that work is chargeable at our daily rate (see Section 2).
4. Liability & limitation of liability
Our liability to you for any claim arising from our services — in contract, tort (including negligence), or otherwise — is limited to the total design fees you’ve actually paid us for the project giving rise to the claim.
We are not liable for indirect, incidental, or consequential loss, including loss of income, loss of rental opportunity, or loss of enjoyment of the property, even where we knew such loss was possible.
This limitation does not apply to, and nothing here excludes or limits our liability for: death or personal injury caused by our negligence, fraud, gross negligence or wilful misconduct on our part, or any other liability that cannot be excluded or limited under Malaysian law.
Material variance: natural materials — including natural stone, solid wood, rattan, cane, and woven or natural fabrics — vary piece to piece in grain, veining, tone, and texture. The sample or render you approve is a reasonable representation, not an exact match; that natural variation is not a defect and isn’t something we can guarantee against. Where a supplier offers a defect warranty, that warranty (not this clause) covers genuine manufacturing faults — see Section 5.
5. Third parties & procurement
Part of our service is sourcing and coordinating the contractors, vendors, and installers your project needs. We vet who we recommend, but we don’t employ them — each is an independent business, and their work, pricing, and delivery timeline are their responsibility, not ours.
Workmanship and product defects: any contractor’s workmanship, or any defect in furniture, fixtures, or materials from a vendor, is covered by that contractor’s or vendor’s own warranty.
Delivery and in-transit damage: once an item leaves the supplier for delivery, loss or damage in transit is between you and that supplier (or their carrier) under the supplier’s own terms. Please inspect deliveries on arrival and raise any damage immediately with dated photos so we can help you escalate it.
6. Design ownership & use of your project
Once you’ve paid for a stage in full, you’re free to use what it produced — moodboard, floor plan, or specification — for your own property. That’s what you’re paying for.
The underlying design concepts, drawings, and creative work remain Sundays in Bed’s intellectual property. We may reuse similar concepts, layouts, or elements in other projects; your payment gives you the finished design as applied to your home, not exclusive rights to a look or an idea. Please don’t reproduce our drawings or concept work for another property, or pass them to another designer, without asking us first.
Photography and portfolio use: by accepting your Scope of Works, you give Sundays in Bed permission to photograph and film your completed project, and to use those photos and videos in our portfolio, on our website (mysundaysinbed.com), and across our social media and marketing, at no further cost to you. We’ll coordinate timing with you (typically once the space is styled and settled) and, on request, avoid showing personal items, faces, or identifying exterior details like your unit or street number. If you’d rather opt out entirely, tell us before signing — much easier to agree upfront than to unpick a shoot afterward.
7. Client responsibilities
For us to hit the timeline in your Scope of Works, we need you to:
- Give us and our appointed contractors reasonable site access when needed
- Provide accurate measurements, existing floor plans, and property information — we design to what we’re told and shown, and can’t be responsible for surprises accurate information would have caught
- Obtain any approval your property requires on your side — typically your JMB, MC, or strata management for renovation works, plus any permit that sits with your contractor as the licensed party
- Respond to design approvals, material selections, and sign-offs promptly — see Section 3 on how decision delays affect your timeline
8. Data privacy (PDPA 2010)
This section covers the personal data you give us to run your project — separate from the design terms above.
What we collect: when you sign up as a client, we collect your name, contact details, property address, budget range, design preferences and requirements, and any photos, floor plans, or documents you send us about your property.
Why: to prepare your Scope of Works, deliver the design stages you’ve approved, coordinate contractors and vendors on your behalf, invoice you, and contact you about your project.
Who we share it with: contractors, vendors, and installers — only the details each needs to quote or deliver their part of your project. Never sold, never used beyond delivering your project and (if you’ve separately opted in) our marketing.
Retention: for as long as needed to deliver the project and meet accounting/legal obligations, then a reasonable period after in case of warranty or dispute.
Your rights: under the Personal Data Protection Act 2010, you can ask what we hold about you, ask us to correct it, or withdraw consent (which may limit what we can deliver on an active project). Contact hello@mysundaysinbed.com for any of this.
9. Termination
Either of us can end the engagement. You can cancel any time — see Section 2 for how completed work is billed. We may end it if payment is significantly overdue, if we can’t reasonably continue (e.g. site access refused for a prolonged period, or a needed decision doesn’t come despite reminders), or if continuing would be unsafe or unworkable for us or our contractors.
Either way: you pay for work completed on the pro-rata basis in Section 2, plus any costs already committed to vendors/contractors specifically for your project (e.g. a deposit on furniture you’d approved). We’ll hand over whatever stage deliverables you’ve paid for.
10. Governing law & dispute resolution
These Terms, and any Scope of Works issued under them, are governed by the laws of Malaysia.
If a dispute comes up, raise it with us directly first at hello@mysundaysinbed.com. If we can’t resolve it between us within 30 days, either of us can refer it to mediation (for example through the Asian International Arbitration Centre (AIAC) in Kuala Lumpur) before starting court proceedings. Subject to that, the courts of Malaysia have exclusive jurisdiction.
